1. General terms for using the website

Using the www.tnt-brothers.ro website (hereafter referred to as “the website”) implies accepting the terms and conditions below. By using the website, the users acknowledge that they carefully went through, fully understood and accepted these terms and conditions.

Asociația Club Sportiv <<TNT Brothers>> (hereafter referred to as “TNT Bothers” or “the Association”) and its founders reserve the right to modify these terms and conditions without prior notice.

2. Skydiving
   • Preamble

The skydiving activity is conducted by the Association for its members. The member status is obtained based on a membership fee payment, for a period of one calendar year.

All published amounts refer to membership fees/contributions of its members in order to support the Association’s activity and purpose.

A person that intents to become a member of the Association may obtain one of the following membership types within the Association:

• ASPIRING MEMBER – Tandem passenger: a person that wishes to take the first step in skydiving by doing one or more Tandem jumps within the Association;
• ASPIRING MEMBER – skydiving student: a person that wishes to follow a skydiving course in order to obtain a skydiving license within the Association;
• LICENSED SKYDIVER – a practitioner that possesses a skydiving license, recognized nationally or internationally, and intents to perform skydiving jumps within the Association.

The registration process for both Tandem passengers and other member types is detailed in the Association’s regulations, available at https://www.tnt-brothers.ro/despre-tnt-brothers section.

Performing a Tandem jump is only possible after:

• Paying the corresponding membership fee/contribution;
• Having your identity and age verified by presenting an original identification document (Passport or Romanian ID card); the minimum age for skydiving within the Association is 16 years; for persons under 18 years of age, it is necessary to present an original written signed and legalized agreement of both parents or legal guardian;
• Having your weight checked; the maximum weight for Tandem jumps within the Association is 110 kg;
• Filling, dating and signing a membership request, which needs to be approved according to the Statute of the Association and applicable board decisions;
• Reading, dating and signing the statement regarding accepting the risks associated with skydiving and personal health condition; for persons above 60 years of age, it is necessary to present a medical letter confirming the adequate health condition or an appropriate medical certificate as defined by the law, in original;
• Following the pre-jump training conducted by the Tandem Master.

TNT Brothers and its founders reserve the right to select the members.

 

• Skydiving invitations

Any person can offer a skydiving invitation to another person, by accessing the “REGISTER A FRIEND” section of the website and following the corresponding steps.

The skydiving invitation is an invitation to become an aspiring member – Tandem passenger, and includes the benefits of performing a Tandem skydive and a subscription to the Association’s newsletter.

The skydiving invitation is generated and used as follows:

• Access the “REGISTER A FRIEND” section of the website;
• Fill in the form, select the jump type and communication method;
• Pay the membership fee/contribution corresponding to the chosen jump type;
• The invitation beneficiary will choose the date and time of the jump by themselves, by using the code contained in the invitation and accessing the “REGISTER / PICK THE JUMP DATE” section of the website;
• At the scheduled date and time, the invitation beneficiary should arrive at the drop-zone, finalize the registration process and is then ready to perform the Tandem jump.

When the invitation is generated, the person offering the invitation is subscribed to the Association’s newsletter.

ATTENTION! The skydiving invitation is valid one calendar year starting from the generation on the website. To use the invitation, the beneficiary must perform the Tandem jump within this period, considering the following aspects:

• The jump can be performed only during the working hours of the Association’s drop-zones; The working hours for each of the Association’s drop-zones are published at https://www.tnt-brothers.ro/pagina-contact section of the website;
• The Association’s activity is seasonal; if the skydiving invitation expires outside the skydiving season, its validity will not be extended;
• If the jump cannot be performed on the scheduled date due to technical and operational factors occurring on the day, and the invitation validity expires, its validity will not be extended; therefore, we recommend scheduling the jump at least one month of the skydiving season before the invitation validity expires;
• If the invitation validity expires without the beneficiary having performed the Tandem jump, the Association will use the corresponding amount of money according to the purpose stipulated in the Statute of the Association, the corresponding jump can no longer be performed, and the paid amount cannot be refunded.

If the person that receives the invitation does not wish to become a member of the Association and enjoy the benefits of this status, the paid membership fee/contribution for the invitation can be refunded within 14 days starting from the payment date, but no later than 24 hours before the scheduled date and time, by filling the refund form (download here) or by sending an email request to [email protected].

• Scheduling the jump

Any person can schedule a Tandem jump, for themselves or other person/persons, by accessing the “REGISTER / PICK THE JUMP DATE” section of the website and following the corresponding steps.

The reservation of the date and time of the jump is completed after paying the corresponding amount, and is confirmed by email.

If the person who / for whom the jump reservation was made does not wish to become a member of the Association and enjoy the benefits of this status, the paid membership fee/contribution for the reservation can be refunded within 14 days starting from the payment date, but no later than 24 hours before the scheduled date and time, by filling the refund form (download here) or by sending an email request to [email protected].

The person that made the reservation may request a reschedule of the jump, by phone or by sending an email to [email protected], no later than 24 hours before the scheduled date and time.

The jump may be rescheduled no more than three times within no more than one calendar year from the date when the invitation was generated, or from the date of the initial reservation (for the reservations without invitation), subject to availability, during the working hours of the Association’s drop-zones, as detailed in https://www.tnt-brothers.ro/pagina-contact section of the website.

The scheduled time is the time of arrival at the drop-zone. After arriving at the drop-zone, the registration process must be finalized as well as other steps preceding the jump. Under normal conditions, the jump is performed within three hours from the scheduled time.

Depending on technical and operational factors this time may be longer, including the possibility that the jump cannot be performed on the scheduled day. In such a situation, the jump can be rescheduled on-site for a future available date, jointly agreed with the person who was going to jump, respecting the one calendar year term from the date when the initial reservation was made. If the person does not want to reschedule the jump, wants to renounce the membership status and to be refunded the paid membership fee/contribution, they can place this request within 24 hours from the initially scheduled date and time by email to [email protected]. The paid amount will be refunded within 10 working days.

ATTENTION! In the event of no-show at the scheduled date and time, or if the jump is not performed due to reasons pertaining to the member, the Association will use the corresponding amount of money according to the purpose stipulated in the Statute of the Association, the jump can no longer be rescheduled, and the paid amount cannot be refunded.

• Technical and operational factors

The Association and its founders reserve the right to delay or cancel any kind of jump, when the technical and operational circumstances (weather, aircraft condition, runway condition, air traffic restrictions etc.) so dictate.

• Benefits expiry period

The benefits associated with the aspiring member status (Tandem passenger or skydiving student) or licensed skydiver status in the Association are valid for one calendar year starting from the date when the corresponding membership fee/contribution payment was processed, except for the benefits corresponding to the invitation to become an aspiring member – Tandem passenger, which must be used within one calendar year starting from the date when the invitation was generated, the member being able to use these benefits only during the afore mention period. After the passing of the one-year period from processing/validation of the membership fee/contribution payment, or invitation generation respectively, if the member hadn’t used all the benefits associated to their membership status within the Association during this period, they may neither request a refund of the membership fee/contribution, nor an extension of the benefits validity after this period.

Any member may support the Association’s activity by paying membership fees/contributions. The benefits corresponding to the paid membership fees/contributions may be used by the paying member or by any other member designated by the paying member (except for the benefits which are part of a bundle, as detailed at pct. 2.6 in this document), within one calendar year from the date of payment and benefits processing, or invitation generation respectively, during the working hours of the Association’s drop-zones.

The Association’s activity is seasonal; if the benefits validity expires outside the skydiving season, their validity will not be extended; the working hours for each of the Association’s drop-zones are published at https://www.tnt-brothers.ro/pagina-contact section of the website.

If the membership status expires before the benefits validity expires, the member must renew their membership status in order to be able to use the benefits. Renewing the membership status does not extend the validity of the benefits.

ATTENTION! If the benefits validity expires before the benefits are used, the Association will use the paid membership fees/contributions according to the purpose stipulated in the Statute of the Association, the jumps and/or other activities included in the benefits can no longer be performed, and the paid membership fees/contributions cannot be refunded.

• Bundles

Aspiring members – skydiving students and licensed skydivers have the option to choose benefits bundles (which may include several jumps), by paying the corresponding membership fee/contribution.

Bundled benefits may only be used by the member that paid the corresponding membership fee/contribution. The membership fees/contributions for bundled benefits is nonrefundable.

If the member utilizes a part of the bundled benefits and then decides not to use the remaining benefits, the member cannot request a partial refund of the membership fee/contribution, neither the utilization of the benefits by another member.

The bundled benefits may only be used during their validity period, as described in these terms and conditions.

ATTENTION! If the bundled benefits validity expires before they are used, either completely or partially, the Association will use the paid membership fees/contributions according to the purpose stipulated in the Statute of the Association, the jumps and/or other activities included in the benefits bundles can no longer be performed, and the paid membership fees/contributions cannot be refunded, neither completely nor partially.

3. Newsletter

Subscribing and unsubscribing to www.tnt-brothers.ro newsletter is free and voluntary for the members of Association, and implies accepting these terms of usage. The sent messages are not spam, and anyone can unsubscribe at any time by following the instructions at the bottom of every email. The sent messages conform to the Romanian Law no. 365/2002 regarding commercial communications in electronic commerce. The usage of the newsletter is subject to the same limited responsibility conditions concerning the content as the usage of the website, as stipulated in this document, and the privacy policy is fully detailed under https://www.tnt-brothers.ro/politica-de-confidentialitate section of the website. The Association holds all the rights covering the contents of the newsletters sent to its subscribers, under the same terms and conditions as for the information published on the website, as stipulated in this document.

www.tnt-brothers.ro newsletter subscribers may forward the newsletters to other persons, on their own responsibility, provided that they haven’t altered either the structure or the content of the newsletter. The persons receiving the newsletter form the www.tnt-brothers.ro newsletter subscribers are considered to have been priorly informed by the subscribers about the provisions of this paragraph. In this context, the Association cannot be held responsible under any circumstances for the actions of its subscribers.

The Association reserves the right to restrict access of any subscriber to the newsletter, if there is any reason to believe that the subscriber fails to comply with this document.

4. Website errors

Despite our efforts, a small number of categories on the website may have wrong contributions / membership fees, wrong descriptions and events that are no longer available, wrongly set by our web application. Taking into consideration these terms and within the limits allowed by the law, we may decline or cancel any request affected by error, even if a payment is already made. In case your request is canceled you will be informed and, if you already made a payment, we will refund the payment in full.

5. Copyright

The content of the website – images, text, charts, symbols, web design elements, e-mails, scripts, programs and other data is owned by TNT Brothers and is protected by the Romanian Law no. 8/1996 regarding copyright and associated right, as well as other laws concerning intellectual and industrial property. Usage of any of the above elements without the written consent of TNT Brothers is punishable according to the law. The usage of www.tnt-brothers.ro website is permitted only within the limits stipulated in this document.

The right to create a web-link to the website is limited, non-exclusive, revocable and is granted as long as it does not bring any prejudice to the owner or any other of our partners, only after receiving our written consent or email approval.
